Georgetown Woman Arrested in Lexington on Felony Charges

A local Georgetown woman, Kimberley Anne Elswick, was arrested by the Fayette County Sheriff's Office on July 6th but was just recently transported to the Scott County Detention Center on October 12th.

The charges include Probation violation for felony offense and Making false statement to obtain increase. The Uniform Citation from the Fayette County Sheriff's Deputy sheds some details of the arrest, but it's unclear to this blog what original felony charges were committed for the defendant to be placed on probation.

The charge of Making false statement to obtain increase is a little more complicated because it involves state unemployment insurance. The Statute, KRS 314.990(5), reads as such:

Any person who knowingly makes a false statement or representation of a material fact or knowingly fails to disclose a material fact to the secretary to obtain or increase any benefit under this chapter or under an employment security law of any other state, or of the federal government, either for himself or for any other person, business entity, or organization shall be guilty of a Class A misdemeanor unless the value of the benefits procured or attempted to be procured is one hundred dollars ($100) or more, in which case he will be guilty of a Class D felony.

There were no further details concerning this crime in any documents obtained by this blog. There was, however, a Scott County Sheriff Uniform Citation dated July 17th, 2011 for the same charge; Probation violation for felony offense.

The defendant is being held at the Scott County Detention Center on $15,000 bond and has a court date scheduled for November 2nd.

More to come on the outcome of this case as it develops.
